Tree rules in North Somerset

  • TPO trees: written consent from North Somerset Council is needed before anyone cuts down, tops, lops, uproots or wilfully damages a protected tree (Tree Preservation Regulations 2012 reg 13). If the council has not decided within 8 weeks you may appeal (reg 19).
  • Conservation areas: written notice under s.211, then wait 6 weeks (the notice lasts 2 years), before work to any tree of 75 mm diameter or more at 1.5 m — even with no TPO.
  • Dead or dangerous trees: a dead tree needs 5 working days' notice before work; work urgently necessary to remove an immediate risk of serious harm is notified as soon as practicable afterwards (reg 14(2)).
  • Penalties: an unlimited fine for destroying a protected tree (s.210; the £20,000 cap was removed on 12 March 2015), up to £2,500 for lesser breaches, plus the landowner's duty to replant (s.206).
